  • Fence laws and dogs.

    Short story guy behind my parents dog (who never gets attention) tore a massive hole in the fence(the fence is legally the neighbors). My parents dog one pound Maltese dog walked through the hole and got tore up costing $700 in vet bills. I am curious if the neighbors have any legally obligation to pay for vet or fix the fence? Any help is greatly appreciated!

    If the fence is on the property line it is both home owners responsiblity. I have been battling my ass for a neighbor behind me for over a year and he keeps breaking the pickets, after is his crazy ass wife came over and threatened to shoot my dogs we called the Police and they said it is a cival matter and both should split the cost since it is on the property line. And like the cop told us if there small dog gets ate up by mine it not our fault.

      My tought is, that regardless of the condition of the fence, your parents are responsible for their own dog. The hole wasn't immediate, it was a known danger.

      Keep the dog away from the fence, until the owners are forced to repair it.

        That's the big thing, they both own it. So his dog getting chewed up was equally and individually his responsibility. Especially since it happened on their side of the fence.

          That neighbor isn't liable for what happened. Get some bricks and plug up the hole for the time being. Been their done that with our neighbors. I had an Akita that would kill anything that came into our backyard. Needless to say our neighbors 3 cats we're slain within a year of coming into our backyard. It's kinda fucked up when they're really good friends with you too LOL.

            Cats should not be outdoor pets, IMO. I had a neighbor with 2 outdoor cats and they were in my yard as much as theirs..

              Also with small dogs to do a perimeter check every so often because that shit happens more then you think. I had a little Maltese that would dig himself a little hole and get out like a dumbass.

                Oh I know... I personally do NOT like cats. The 2 deaths we didn't say shit about, just a trash bag and all was well. Reason behind that was because they had really little kids at the time. The 3rd the cat was fucking with Zeus on the top of the fence and fell into the backyard. Cat took off and found the nearest hole that he could escape from. Some how and to this fucking day we don't know how he did it, but he fucking busted through the fence and chased down the cat and snapped his neck right in front of my neighbor while he was getting the paper. True but sad story because we had to get rid of him after that

                    I respectfully disagree. Had the owner not allowed their dog into danger, no harm no foul.

                    If your kid hops the fence, and nose dives into the Grand Canyon (heaven forbid), are you going to sue the state of Arizona, because it happened there?

                      I thought the property owner is reponsible for any injuries on his property. Woulnd't the o/p go after the property owner if it was his kid instead of his dog?

                        I think if it happened to be a human and the dog fucked him up then I believe so. I've heard of a lot of stories about this happening. The kid climbs the fence like an idiot and falls into the neighbors backyard and gets fucked up by the dog.

                          I've been in this situation before. The Animal control officer stated that if my dog killed the other dog on my property it was ok (just protecting its property) but if the dogs out side the property line it's on me. Fences don't matter it's the act that is the issue.

                              Same with a pool, if a kid "accidentally" gets into your yard, and dies in your pool, then the homeowner can be sued. Which is complete BS if you ask me.

                              Where are the parents/owners, and their accountability?
