question about child support

    Thought maybe someone here would have experience with this.
    Currently I pay 800 a month and am responsible for maintaining insurance on him which is 350 a month. If she would have provided the insurance my child support for one kid would have been 1150. Well my compwas bought out and I am fairly certain I will be taking a pay cut. My question is since I've had another child since those orders were written(I don't pay child support with this one being that he lives with his mom and i) can my child support be reduced now that I provide for 2 kids?

        You can go back to court to provide documentation of changes in your wages to try and reduce the amount you pay in child support, but once that amount is originally set it is difficult to reduce. You will probably have to make significantly less now than you did when the child support order was made in order to get the child support reduced. The court won't care that you have another child, that is your problem. All they care about is the child support order against you.

            The first child always takes precedence. You could father 12 children, and your first baby mama will continue to get her same percentage. Your case is entitled to review every 2 years. If you make less, it can be adjusted, but if you're not already paying the standard 20%, you might end up screwing yourself in a review.

              Most of this... I don't know how it would work now that you have a second child, but I can tell you this.

              Child support for one child is 25%. I, however, and full and sole custody of my son. So when my ex and I divorced, because I have my son, they can only take 17.5% of my income for my daughter's support. It has to do with me being my son's sole provider. But like LS said, good luck getting that amount reduced. They will bend you over every chance they get, but won't be looking to do you any favors.

              My son's egg donor has never paid a dime in 10 years, and never spent a day in jail for it, despite going to jail for other things, and spending six months in a state run rehab. The folks at the OAG were so kind, they called me three times asking if I knew where to find her. I gave them the address to the state rehab facility she was in 3 times. They then took it upon themselves to close my case, meaning I have no recourse and will never be able to collect the $30,000+ that's she owes.

              Why would they do this, you ask? Because I have a dick, and a set of testicles. If you or I missed a payment tomorrow, the Constable would be waking you up on Saturday for an all expense paid vacation to Lewis Derrick. Welcome to Texas. Bend over, and relax your muscles. Fighting it is only going to make it hurt worse.

                Alright devils advocate that is married with three kids and never been divorced. How does a man keep from getting raped on child support soon after a divorce? It seems incarceration is the only way, right? What if I were to leave the country?

                  South America, that's how. Then put a check in the mail for an amount that you feel is right every month. I laugh when I hear someone is paying $800 a month for what is supposedly half of what it costs to support a middel class kid. Maybe if the kid goes to Hockaday that makes sense, or drives an Escalade to school. I'm sure I'll get some dumbshit in here to talk about how kids have a lifestyle to maintain.

                      Nope. While you are in prison, that amount keeps adding up every month. Then they will garnish up to 50% of your paycheck when you get a job until you are caught up.

                      Want to get out of child support? Move to Mexico, never come back, and hope they don't find you.

                          Most will have mediation before a judge makes decisions. You have a shot there to come to an agreement, perhaps you can convince your ex to take a set amount or no amount. Its a longshot, but worth trying.

                          My divorce will be final next Friday and my child support just went up to $600 a month. Its bullshit that I have to struggle while I subsidize my ex. Judge could care less about all the goofy moves she's done. I really wanted to appeal but I've already dropped far more then I was thinking I would have spent and I'm simply out of money. Just gotta regroup for the next years and see what I can do later down the line.

                            From what I've seen with buddies and their divorces the ex wife goes ultimate bitch mode and never make it easy

                              By carefully picking his future ex-wife. A guy can get out of a marriage unscrewed, but it really depends on the woman.
