  • Unemployment question

For those who know how the system works, if I got let go by my employer on the 23rd, which was the last day of the pay week, and my claim doesn't start til the 25th (which is part of the new pay week, and I have no hours for that week since I got canned) am I gonna get hosed on my benefits?

and before I get flamed for claiming unemployment and get called a bum and shit, this was a 14.28/hr delivery job that I actually enjoyed doing which I got shitcanned from 2 days before Christmas by a manager that made sure everyone knew he'd never had anyone claim unemployment on him.

If you got fired for a reason I don't believe you can collect. What did you do?

You're not gonna get hosed on your benefits, but you will be going a week or three without any income. If I'm not mistaken, when I initially filed back in 2009, my first payment was delayed a few weeks.

I've collected before after being fired, but there were extenuating circumstances that helped me out. They said I damaged a refrigerator during a delivery and the company had to give the customer a discount which cost them money, but they couldn't provide me with any information about the customer, the date, or even the model number of the fridge so I could properly claim fault or defend myself and prove it wasn't me.

If they do not have a bunch of write up forms on you, I would think it would be hard for them not to pay.

the employer pays unemployment taxes regardless if they fire anyone or not, it's required by law for MOST employers. they can make shit up about you but they have to provide proof.

                this.

Burden of proof is on the employer, and there have to be pretty strong cases for them to get out of paying.
