There are no courses on "insurance law" in law school - at least I know I didn't take any. It falls under the gambit of Contract Law. While I am well versed in general contract law, insurance can be whole separate animal when it comes to the nuisances relating to it. I don't think I've ever had to review an insurance policy in my 12 years of practice and I've never had an issue like this come up personally. I handle entirely different areas of law. Could I research the issue and find the answer? Sure I could, but my original questions had nothing to do with that. Any more questions Michael Myers?

You are seeing the scenario through a lawyers eyes, quit being smart, and listen to us common folk that have been there and done that.

As Ms. Chest has pointed out, people have insurance to reimburse an agreed value for loss, there is nothing in the policy that stipulates what you do with that money once the value has been determined.

For instance, if the entire truck was stolen, the insurance company would pay $25k ish as a guess. It isn't fraud if they go find an older completely different vehicle for $5k and put $20k in the bank, or not buy a car at all, take DART for a while, and spend it all on hookers and blow.

When the house got robbed, we sent reciepts for what was stolen, and were sent a check for fair market value. Some things were replaced, and the rest went towards new stuff, and in the bank.

In this case it really depends on how the insurance company is going to value the seat, and what it's worth to them to deal with it. Even at $1000 to meet the deductible though, they'll net $250.

Makes sense to me. Despite my occupation, I'm about as "common folk" as anyone on here, but just haven't had this issue come up.

This happened to my roommates '06 F250 KR. They took the seats and console then dumped the car, but not before taking a giant shit in the cab(What the fuck?!)

The truck was recovered still in great shape except for the seats and the shit, and it was totalled.

My first response to your post was "HOLY CRAP", but I'm sure what was left in his truck was FAR from holy. My buddy had something similar to that happen on an his '91 LX when it was stolen. They took it, stripped it and then took a pic that was in the car of his girlfriend and stabbed a little knife through her face and into the dash. Unfortunately, they were smart enough not to leave their finger prints on the knife.
