  • Diminution in value claim for auto collision and car fax reports

    My wife's truck was recently hit on the rear bumper. The person who hit her took responsiblity and we are currently getting it fixed (thanks ShagginWagon!). It wasnt a massive hit. It cracked the bumper cover and bent the trailer hitch.

    2 questions:
    1. At what point, does something show up on a car fax? Would this?
    2. If it will show up on a car fax, then I KNOW that will make the car harder to sell. Does something showing up on a car fax give you a valid arguement to demand diminution in value be paid when you are not at fault?

    IT will be hard to get anything done on a round of the mill truck. I'm still fighting with a company about getting mine done and theres about 300 in the states in that year of my car.

      Was this filed through insurance, or did the person responsible pay out of pocket?

        Filed through insurance. It was actually in a company car so it was filed under the company this guy works for.

          Good luck, I tried the same thing when my wife got hit and they just ignored me. On the other hand I never signed any paperwork saying the case was settled so I assume it still open; I believe you have to sign something for them close the claim. If that is true just don't sign shit until they give you them money.

            If you cashed the check it was implied that you agreed with the settlement, at least that's the way I understand it.

              Signing the check does not stop you from filing the claim. The payout depends on the amount of damage. You can try it but I wouldn't expect to get much.

                You can file for diminished value after the repairs are done. I successfully filed a diminished value claim on my jeep last year, but there was $6,500 in damage to it. You have to have a decent amount of repair done, it has to be completed, and you need to have a rock solid case.

                    Greg just fixed my fiance's Mini Cooper... Allstate is sending someone out to check out the diminished value without even asking about it. We had to file under our insurance for an uninsured claim. Just go after the "inherent diminished value". Allstate told her to stop by a dealership and get an estimate for trade in value and they will meet between the adjuster and the dealership quote on loss.

                      diminished value is as much of a joke as the car fax reports you people put so much faith in.

                      just an unfounded, personal estimate... i think it is a fair assumption that one out of twenty five cars on the road today have had repairs done that are incorrect and dangerous.

                      if you take your vehicle to a quality shop, the insurance company will ask them to fix anything that they see as sub par, or affecting value. and a quality shop will, for the most part, comply.

                        I wouldn't go that far, its more of a car thats rare or expensive that wrecks actually do hurt the actual value.

                            It depends on who the insurer is that paid for the repairs. Some insurers don't report to Carfax. Was a police report done? If so, it'll likely show up on a Carfax.

                            When I was involved in an auto-bicycle claim in 2009, my Mustang had no damage at all, the bike just left rubber marks that wiped right off. However, the accident still showed up on a Carfax.

I got had it repaired by the body shop, then took it back to the Toyota dealership I bought it from and had them give me a signed quote as to value lost after they inspected it. Faxed that to the other's insurance (same number I sent the first bit of info about the claim to) and never heard back. Each time I called the "agent" who was assigned to my case I was told a different agent was over it. Each call ended with me getting transferred to a voicemail, and I never once got a call back from any of them. This was Hartford insurance, by the way. At any rate, my insurance company got them to pay for the repairs, but said I had to deal with them on the diminished value claim by myself. They ignored the shit out of me. Fuck Hartford; I hope their office catches on fire.
