  • Suspended License / Speeding Ticket - 3+ years ago

    A friend of mine was taking me to LG Motorsports a few years ago and got a ticket on GB right where it exits for 78 in Garland by firewheel. He had a suspended license at the time but the officer didn't say anything about that, just gave him the speeding ticket and we went on our way. He just now paid the ticket last month and the state sent him a letter this week that says...

    "Your Texas drive license, permit or priveledge to operate a motor vehicle will be suspended for an additional period of because it has been determined that you operated a motor vehicle on a highway while your license or driving priveledge was suspended, cancelled, disqualified revoked or denied. If you do not request a hearing, your license will be suspended from 11/18/2011 through 06/18/2012."

    It also says...

    "The issue before the presiding officer is whether the grounds for the suspension stated in the notice are true. If the suspension is sustained, the presiding officer will set the period of suspension not to exceed one year. An occupational or essential need drivers license may not be issued for the operation of a commercial vehicle."

    Is that even fair?!
    There was no ticket at the time for "driving with suspended license" Would there be a ticket now for that?!
    How does this work?!
    Does he need an attorney? Could an attorney fight it and win?

        Maybe "he" should be more careful not to break the law the next time "he" decides to break the law.

            The problem is his license is fine now and has been. Why wait 3 years for the state to do something about it? Seems pretty stupid if you ask me to be like "oh you were driving when you shouldn't have been 3 years ago - here's a ticket now for doing it." Seem's like if they were going to do it, they should have done it then.

              Guess the state figured out that if you got a ticket while your license was suspended you also drove on a suspended license. Who would have ever guessed

                Of course they did. I just think they should have given him a ticket then instead of making a big deal out of it now.

                  Statute of limitations on that was probably about to expire, so they snuck it under the wire. If the statute of limitations hadnt expired, your buddy is fucked and has to take it. Can you fight it? Sure...but kinda pointless since hes guilty.

                      I'm sure the timing has to do with the fact that he just finally paid the ticket.

                              This ! By paying the ticket in an untimely manner, automatic guilty verdict. unless he wanted to pay cash bonds (lots o cash) to get the speeding ticket back on the docket and fight it before the judge.

                              Your buddy made his own bed. He should feel lucky they didn't arrest him on the spot, impound the car, get his licensed suspended longer and would have been on probation for 1-2 years as a final kick in the balls.

                              So this actually worked out better for. He didn't go to jail and he is not on probation. Trust me on this.
