  • Need advice on a speeding ticket.

    My brother-in-law got a ticket for 78 in a 75. I know it was less then 5 mph over the speed limit. He bought the suv with 20's on it. Never did he think or know the tires were not the right size for the vehicle. Causing the speedometer to be off. Is this something that can be excused in a traffic court? Do you think he has a chance to fight it? Thanks in advance for any input/advice.

    In no way am I saying he is a perfect driver. But he knows the cruise control was set at 75 when he was pulled over.

      Dude, I have to call bullshit on 3 mile over the limit. Ask any Police officer on this board and I think you will get the same responce.

            I believe it. Sounds like some Podunk town bullshit. I've heard of plenty of tickets in Dalworthington Gardens for 1 over.

              I make a point of driving around Dalworthington Gardens, rather than through, if I'm ever in that neck of the woods. Mostly leery about Pantego as well.

                If he argues about the speedo being inaccurate in the town where they would write him up for 3 mph over, he can probably expect to get a ticket for defective equipment as well.

                  I took my CHL from the Chief of Public Safety in Dalworthington, after taking that class I would never even contemplate breaking the law there lol. He was a cool guy and I enjoyed the class, but don't fuck around in his town.

                      Within a few miles from Pueblo, Co. What happened a cop was in the right lane of the 2 lane highway. Driving like 60 mph (speed limit 75). He passed him and 3 minutes later the cop pulled him over.

                        I've left a few nasty messages for the Chief of that town over the years for their Officers driving like absolute shit and almost hitting me. For some reason I've never gotten a call back. Go figure.

                          dont waste your time. in the end is the court cost/attorney/time spent going to be worse than what it cost to defer or just flat out pay the ticket?

                            In the end, the court will say that the driver is responsible for all equipment on the vehicle they're driving (including speedo matched to tire size) and he'll still be found guilty.

                            I don't know what Colorado offers, but maybe he can ask for deferred adjudication, probation or defensive driving class?

                              I bet it was a Trooper, they are notorious for that. I would fight that ticket all day long. Was he pacing him, how do you know his speedo was correct? When was the last time he had his speedometer calculated? Has he had signifigant tire wear since then? Would any any reasonable and prudent person find that speed unsafe on that stretch of the highway during the same road conditions. FTP!!
