House just abandoned. How to find the bank/owner?

        It won't hold. I believe it's illegal to occupy a home with no water/electricity, not to mention the back taxes owed on the property, etc...

        The dumbass should have kept quiet-now people are really going to try and find the loophole.

          To me it is a joke. I have pride and integrity. I would hope no one on here would try doing something like this. I don't want handouts and work for everything I have. I bet he is gone within a month. The guy looks like he is homeless and honestly believes he deserves it.

            So he put the time in, found the loophole, exploited it, and that bitchy neighbor of his and you are jealous because he got it for $16? Why should he pay a dime more than he has to? Because she did? Fuck that. We need more ingenuity like that in this country, not less.

              So you look for handouts? I would be pissed too if some trashy mfer moved into my neighborhood and is trying to exploit the system. The point is, someone owns that house. The bank does or the family forced out. A family lost it because they could not make the payments ( I'm guessing) and he breaks into the house and files some stupid paper with the county. The only thing that is keeping this guy from being in jail, is the fact that the bank has not stepped up yet. If it hasn't completed the foreclosure process, then as soon as the original owners get wind they may come back and have the guy arrested. It is pathetic.

                Also FWIW it looks like he has to live there for 10 years. By the looks of that house I am betting that there is an HOA also. He will be lucky if he is there another month.

                Sec. 16.024 - The Three-Year Statute

                A person [i.e., the original owner] must bring suit to recover real property held by another in peaceable and adverse possession under title or color title not later than three years after the day the cause of action accrues.
                Under this section, the possessor must have title (i.e., a deed as part of a regular chain of title) or “color of title,” which refers to a claim of title that has some reasonable basis but for some legitimate reason does not fit within the usual chain of title. So, the possessor must be able to produce some conveyance/title paperwork to support his claim if he is to assert adverse possession.

                Sec. 16.025 - The Five-Year Statute

                (a) A person [i.e., the original owner] must bring suit not later than five years after the day the cause of action accrues to recover real property held in peaceable and adverse possession by another who:


                (1) cultivates, uses, or enjoys the property;
                (2) pays applicable taxes on the property; and
                (3) claims the property under a duly registered deed.


                (b) This section does not apply to a claim based on a forged deed or a deed executed under a forged power of attorney.
                Under this five-year statute, some sort of deed of record is still required.

                Sec. 16.026 - The Ten-Year Statute (Nicknamed the “Bare Possession Statute”)

                (a) A person must bring suit not later than 10 years after the day the cause of action accrues to recover real property held in peaceable and adverse possession by another who cultivates, uses, or enjoys the property.

                (b) Without a title instrument, peaceable and adverse possession is limited in this section to 160 acres, including improvements, unless the number of acres actually enclosed exceeds 160. If the number of enclosed acres exceeds 160 acres, peaceable and adverse possession extends to the real property actually enclosed.

                (c) Peaceable possession of real property held under a duly registered deed or other memorandum of title that fixes the boundaries of the possessor’s claim extends to the boundaries specified in the instrument.

                  That's not taking a handout, that's being savvy. Read the article before you break out your jump to conclusions mat. The mortgage company went out of business, and the owners abandoned it, rather than face foreclosure. He's not taking government money to stay in the house, which is more than I can say for a lot of, "mortgage paying Americans," these days, and if he stays current on the taxes, and keeps the house in good shape, he's actually contributing to the community equally to his neighbors, and they shouldn't care what he makes, how he got the house, or what he does with it. If he says he found a key, and there's no evidence to support him breaking in, then you've got to take him at his word until new evidence to the contrary surfaces (and if it does, fuck that dude - get him out of there yesterday). If you want my honest opinion, it's that he knew this house was going to be foreclosed on, and was probably scouting as many as he could, and this was the nicest one that fell into this category. Houses are taken this way much more often in poorer neighborhoods. If you just don't want to live next to the man, that's one thing, but let's keep this about what it is. He lucked the fuck out.

                    I realize they are saying the mortgage company went out of buisiness. However there is still an owner of that company and I am sure he still wants his houses. They don't just fall off the face of the earth and don't care about their $$. Finding a key or not, he broke in. You can find the key to my house, doesn't mean you can come in.

                            I don't believe it is illegal to occupy a home with no electricity / water. How would the Amish not have a shitload of fines, or hunting cabins for that matter? That being said, I can't imaging anyone wanting to live in the Texas summer without electricity to run A/C.

                              Well dang. My dogs got my attention that someone was next door so I went out and met a gal who was next door with a clipboard and camera I talked with. She was hired by the bank to verify status of the property. She said it is owned by BOA and that they will send her out 2 more times to confirm the client has abandoned the property before they do anything. She said it will be prob 3 months or more before they send anyone in to clean it out and attempt any upkeep. She said she has 80 houses in Mesquite she has to do this with. Not really surprised. I went over next door and walked around to see what the damage was. Its pretty trashed. Not to mention the house had some mexicanizing decorating so they will prob strip out the sheetrock and bust up the tile floors. I got a good raise and promotion and starting to be tempted more and more to move and rent out my place, but it seems like a lot of rent houses are even remaining vacant longer not to mention the pain of everything related to renting out a house.

                                Good luck with squatters as well. My dad's neighborhood turned to shit a few years before he passed and was in the same situation you're in. Ironically enough we walked from his house as well since he owed more than it was worth and CA law stated the banks could not go after borrowers. To my knowledge almost 2 years later the banks have done nothing with the property.
