  • Insurance Question: Pre-existing Condition

    Story:

    Out of work for awhile, with no insurance. Got a job, but didn't like my employer's healthcare plan one bit (it was a complete joke). So I bought a temporary policy since I could now afford one, while shopping for a regular policy. I injure my knee while on this temporary policy, and the need for surgery has yet to be determined (MRI negative/inconclusive). It seems like it's getting better, but it's still painful when just walking up the stairs. If it turns out that I do need surgery down the road, will my insurance deny this and deem it a PX, or is there some sort of law under HIPAA or something that would prevent a new insurer to deny coverage for that?
    How do we forget ourselves? How do we forget our minds?

    I believe that was part of Obama health care plan for them to not be able to deny you for a pre-existing cond...

      That does not kick in until 2014. That's one of very few (if anymore at all) provisions of that plan that I was in favor of.

        If you have coverage in place and then get injured, then go to another insurer they probably will cover it.

        I use to always have this issue since I am diabetic, but the laws changed where if you have already have coverage (it may be for a year, or maybe 6 months) in place, then change insurance carriers, they will cover it.

        What they don't want is someone who has no coverage, gets injured or some medical condition, then pays for insurance and tries to use that to cover all those medical expenses.

              They can only deny when you have had a lapse of coverage for more than 62 days. If this is a new diagnosis on your current (temp) insurance, they should not be able to deny anything. They could deny some chronic disease like diabetes IF you have had a lapse in coverage for the length of the lapse in coverage.

              So, if you went 1 year without insurance, then jump on a new insurance, the new company can deny your diabetes treatment for 1 year. If you lapse for 6 months, then they can deny paying for 6 months. I think its a max of 18 months denial.

              Anytime you get a new insurance plan, you need to get a letter of credible coverage from your previous company to submit to the new one so you avoid all this mess.
