The box that the officer writes the details says "Officer's opinion of what occurred".

It is by no means a closed case of who did what wrong.

Of course every hit and run is going to look biased because there is only one person's side.

Well, just got off the phone with his insurance company and with a police report that states it is a hit and run, that there were signs posted that he had to merge into MY lane and the fact the guy is avoiding everyone, they are still initially denying liability because HIS story conflicts with MY story.

Fucking really? Of course it does. He's been lying to the cops since it happened. Why wouldn't he be. ARGH!

Similar thing happened when I was in KL and Dez got into a wreck. The kid who hit her wasn't returning calls and was ignoring the insurance company. I had to do some research online and found his parents. Apparently they were part of some District in Fort Worth and within an hour of speaking with them he started returning calls.

I think it is shitty that if they don't acknowledge a claim, the claim is void....

This may have been brought up and I forgot where it happened but were there no cameras around or anything to possibly prove he was at fault? Were there any tire marks on the concrete, from you or him? Maybe find out his tire size and reference that to the almost perfect circle on your door? There seems to be some scratches with no rubber, does he have any body damage?

Id be doing everything I could to get that fucker to pay, small, stupid or pointless, id be doing it.

That's not what's happening here. He's (the usaa insured) denying any involvement and his insurance company is required to investigate every aspect including but not limited to their insureds statements and that of the claimants. After his initial denial of involvement to his insurance company he quit cooperating altogether.

USAA is forced to give him at least 30 days from the date the claim was made to cooperate with the investigation. As part of your insurance contract with your provider, one of you primary duties after a loss occurs is to cooperate with the investigating team to determine liability. Once he hits the 30 day mark they'll have to make a determination of liability based on the statements provided by the cooperating parties and pay out accordingly.

Right now they're simply following protocol, but with all the extra adjusters trying to be helpful, they're causing more confusion since they're all giving conflicting responses.

Thank god we got the manager back on the phone today!

Have you obtained an estimate yet? If not, go get one from a reputable body shop or from an Acura dealer and have it ready for the next phase

Yeah, even under the tire marks, it's rubbed down to bare metal.

I did go to USAA's place (Craig's Collision) to get a 'courtesy estimate' on the 13th so they could have fresh pics before we tried to make it look any better. All I've done is get a car wash so far and it didn't do shit. lol

UPDATE: USAA is paying the claim and is mailing me a check for what the estimate showed. I've never had it done this way so I assume that if the total cost is higher, the shop will just contact USAA?

I need some body shop recommendations now so I can get this done! Anyone have a recommendation in the HEB area?
