Word. I was thinking the same thing..."isn't it just a class c ticket?" Just pay the damned thing. Hell, it was when I got one. I paid it, and have never heard one thing about it.

The industry I'm in is highly highly scrutinized... they'll find anything (my employer/potential employers checked SAT scores, high school class ranking, undergrad transcripts, activities in college checks, MBA GPA, GMAT, CFA level and membership... and of course any type of criminal background checks). An MIP from age 19 has never shown up on anything.

Most people I talk to have nothing but good things to say about you, but you sure come across as a condescending prick. Do you have an inferiority complex you've attempted to overcome through overachievement? Or were you fondled as a child?

You and slow99 should date. You both have passive aggressiveness down pat.

You obviously weren't sober either. Hell had you been driving you could have been given a DUI + MIC plus anything else that possibly got you pulled over.

Why don't you start here: http://www.bne.state.tx.us/exam-eligibility.htm and scroll down to the part that reads 'eligibility issues,' then you can read about the process for a declaratory order here: http://info.sos.state.tx.us/pls/pub/readtac$ext.TacPage?sl=R&app=9&p_dir=&p_rloc=&p_tl oc=&p_ploc=&pg=1&p_tac=&ti=22&pt=11&ch=213&rl=30
Once you finish up with that, you can explain to me why I've been so grossly misinformed that I am going through this process for a Class C misdemeanor for a non-moving violation that was dismissed, that had nothing to do with drugs or alcohol. Then, you can tell me that a Class C misdemeanor for a non-moving violation has absolutely no effect on your life. Will it keep me from sitting for the NCLEX? No, but it's a pain in the ass that I wouldn't have without it on my record.

Sounds like you gave up too much information and this state board (revenue generator) took advantage of it. A criminal history will pull up Class B's and above and you DL return will have traffic violations. Where could they pull up information on anything else? It is strictly a municipal record, unless the DPS enters it on a DL (which I've never seen).

If you're not convicted of a crime, how can it be held against you? That's grounds for a law suit. Then again, it was your choice to become a nurse. It was NEVER a mandate.

Sorry to say, you could have avoided it.

Check out H. and I. If you've ever been arrested or cited with an offense, it must be disclosed. Sure, you can choose not to say anything, but when it comes up on a background check, your character comes immediately into question. I'd much rather own up to the fact that I made a mistake, than try to lie by omission and take my chances.

I never said that my educational choices were a mandate, but we're not debating that. What we're debating is your statement that a class c misdemeanor has no bearing on your record. My circumstance is more of an imposition than a deal breaker, but it's still a consequence of youth and stupidity.

Again... how is it going to come up on a background? It does have no bearing on your record. Read my post again. A CCH will record B's and higher.

In my case, I found out about the charges when I was arrested during a routine traffic stop. If you are correct, and a class c isn't reported, the arrest will still show up on a background check.

Well, now you're talking about a whole other issue. You said you were going through all of this on a Class C, non-moving violation that was dismissed, not arrested on a warrant.

Arrest or no arrest, I wouldn't sign an application stating that I've never been cited for anything other than a moving violation if I had.
It's apparently a difference in personal conviction that you and I don't see eye to eye on.

It's none of their business what I haven't been convicted of. When I joined the PD, I didn't tell them that I mooned some cops while I was on a school bus during a field trip. There is a lot I didn't tell them, but would have raised red flags for sure. I don't think there's a big deal there.

They can ask questions that invade my privacy all they want. It isn't right of them (as in your situation), but if someone asks and gets an answer they can use against you, it's your own fault.

Technically, if you were wrongfully charged with something and let go, you'd have to tell them about it, right? Why should they be able to use it against you?
