im 18 i was riding with some friends, we got pulled over by the lake... one friends told the cops that we had 2 bottles of vodka inside a underarmor bag. took a breathalizer test and it read .074

I got one in high school, I was able to get it deferred. I think the fine was around $300, plus I had to take an alcohol awareness class. That was almost 10 years ago, so the fine is probably more these days.

You are lucky that it wasn't a minor in consumption, as they result in a mandatory 6 month DL suspension(hell, they might do that for MIP now, I'm not sure).

Edit: You are REALLY lucky if you blew over .00 and got the MIP instead of the MIC.

If you can't get a lawyer, talk to the DA about deferred adjudication, would be my guess.

I would think if he blew dirty, he doesn't have much hope of getting it dismissed, deferred is his best bet.

I got one at 18 but got off because 1) I hadn't been drinking and 2) the arresting officer searched my vehicle on the assumption I had been drinking. Turned out that my mountain dew wasn't quite the probable cause that the officer thought it was so the charges went away.
