        This happened right up the highway from my work. We've delivered a lot of stone in that area, the people are really uptight.


        I think this is an instance where the "fast lane" to the chair should be reality. He obviously killed the guy, for no good reason I.E. self defense.....it's murder. He should die. No tax burden, little to no court cost.

        That's just my opinion....worth 2 cents to some and less to others.

          At this time, there is too little information to reach any substantive conclusions.
          If the dog or the owner was aggressive in their approach, this story could change.
          If it can be proved that neither was aggressive, then the shooter is going to prison.
          And there are several scenarios in between these two extremes.


          It is curious to note the absence of any racist, stereotypical comments.

              Meh, no one knows what the hell happened. He shouldn't have shot the dog, that is pretty much a given, although legally he was probably well within his rights to do so. Asshole move no matter how you look at it. But for all we know, the old guy took his golf club over there after the dog was shot and commenced to whip this dude's ass with it and he defended himself.

                More than likely that will be his side of the story regardless of what happened. Unless there are witnesses to what actually happened, I don't see this guy going to prison beyond him just confessing to killing the guy for no reason. He will be out a shitload in legal fees for this though.

                    Clubs. Check
                    Beer. Check
                    Sunscreen. Check
                    Wallet. Check

                    Dog - still at the house. Check.

                    I've been playing golf for about 15 years. I have NEVER seen a person bring a dog with them.

                      Friends say 58-year-old Shellman Smith of Denison was near hole three. That's when Smith's dog wandered onto private property. They said they heard a gunshot. Smith then confronted the homeowner to see what was going on.
                      Seems like the devil is in the details. If he just walked up and asked "hey, what happened?" and got shot, the homeowner is going to prison most likely.

                      If we went in like R Lee Ermey screaming like a Drill Sargent making threats, well I doubt he'll get any jail time.

                          Agreed, If he genuinely feared for his well being, its understandable. If the dog attacked, he is justified. If the owner attacked, he is justified. I'm willing to bet the truth lies somewhere in the middle.

                            Things are done differently in a small town, if I could get away with it I would take my dog golfing too. If I could keep her from snatching the golf balls.

                            I went with a friend to visit his grandparents who live in a small town outside Wichita Falls, we found his grandpa parked on the side of the road talking with the sheriff while he was drinking a beer in his truck. My great uncle lives in the same town, can barely see and still drives, everyone in town just knows to stay out of his way lol.

                              My neighbor takes his lab everywhere in his golf cart. When he stops, dog gets out and sniffs around, maybe pisses somewhere.

                              Not knowing the disposition of this guy's dog, but I'm willing to bet it was along similar lines. The person who shot the dog was a widower for a couple of months. I'd throw in a little depression, dog leaking on former wife's favorite flowers then some unspent anger...

                                ...and then they showed everyone watching the news exactly where this guy's house is. Can you imagine what is probably about to start happening over there....hell he'll be lucky if it isn't burned to the ground in a week by some PETA loon.
