  • Having a gun with a felony

    This is all theoretical.

    Lets say you were in prison for domestic aggravated assault with a deadly weapon. Regardless of whether the person is guilty or not, you served your time and they gave you the rest on 10 years probation, all of which is served.

    What is likely to happen if a weapon is caught in your possession while in your vehicle. Is it possible to not serve prison time for this?

    Its hard to read and process all the bullshit online, was hoping someone might be familiar with a similar situation.

    It's possible to not serve prison time. You can be placed on deferred or probation.

        Pretty sure if you are a convicted felon it doesn't matter whether the person was actually guilty or not so.... You get mad and truck someone in your skaterfag days? It said you can apply and in some cases be approved for one after serving your sentence and probation if applicable. Not that it matters because it doesn't apply to this situation, but was something I read on the side. Would be nice to hear if anyone knows about that as well.

            Speaking of felonies.

            If I'm carrying in the car with a felon, and we get pulled over, could he get in trouble?

              There's time requirements after full discharge of the conviction, but once those time frames are up, a felon can own a gun in their home in Texas.

              If a guy you're riding with is a felon and you're carrying, he couldn't possibly get in trouble because possession would be rather difficult to prove if the gun is actually on you.

                If they admit to knowing that it is there it is considered "Constructive possession" and they can get time for it.

                      Midway through the drive, he mentions he has a felony. Its not his obligation to tell everyone he's around, him is it? nor is it my obligation to tell anyone other than the police that I'm carrying. I honestly didn't know the deal with that.

I can give you hundreds of examples of people who were convicted in Federal court for constructive possession when another person had a legally held firearm on them. Unless you are very rich you basically have no rights and ZERO chance of being cleared in a trial even if you are not guilty when dealing with the Feds. The whole constructive possession thing is basically legal fiction that is used to fuck whom ever they want to fuck.

                        Edit: I know a girl with a CHL that did nearly 8 years in both the Federal prison and TX prison for possession of a firearm in furtherance of a drug crime when she had a gun in her purse and no drugs on her all because the cops wanted to strong arm her into becoming a snitch against her estranged brother who was heavily involved in drugs.
