  • Supressor with ATF Stamp ?

Neighbor's Brother passed on but had Legally bought and registered with ATF a suppressor - year's have gone since purchase and he just passed on ....

so what happens to the suppressor in the estate?

Can the brother keep the can or does he have to re-register it?

It depends on how he bought it.

Is it a trust item or personal?

If trust and all the grantors are dead, it will need to be FORM 5 to the beneficiary per trust.

If individual registered, Does he have a will? If yes Form 5 to beneficiary. If no on the will a Probate Judge will decide whos the beneficiary.

When filling a Form 5 there is NO CLEO signature, ignore that section. Fill out two copies, finger print cards, get a certified death certificate, a copy of the trust/will/or probate judge order and send it to the BATFE.

          Its Tax Free
