    Today, the Obama administration announced two new common-sense executive actions to keep the most dangerous firearms out of the wrong hands and ban almost all re-imports of military surplus firearms to private entities. These executive actions build on the 23 executive actions that the Vice President recommended as part of the comprehensive gun violence reduction plan and the President unveiled on January 16, 2013," reads the White House's announcement.

      wait what? can he do that?

      They are just requiring back ground checks? Doesn't that happen anyway when someone picks up their firearm/suppressor from the FFL?

        No, not for nfa items. You fill out a form 4473 for the dealers record, but on the back of the first page there is a statement that if the transfer is for an nfa item no further action including a background check is needed.

        Also I do not believe Obama can do this, because if he could immediately implement this rule by the stroke of a pen he would. That is why this is going to follow the traditional 90 day ATF review to see if this is a plausible action.

        In my opinion it is not. Transfers for class III items are going to be up to a year soon and if the examiners have to perform a background check on everyone affiliated with the trust, we may get our NFA items by the time they are reading our eulogies. Also, think about how ridiculous this rule would be if it was extended to corporations. Do you really expect all board members of major corps to submit fingerprints and photographs and fill out a form 4 for every transfer they make if they wanted to acquire a competitors gun/suppressor for testing or something?

              He probably would have, however his advisors have probably mentioned the lack of public support and the fact that with everything else he has to deflect, public support has dropped off a bit from back in January/February. He is just trying to gain back some of the voter confidence he has lost and I feel this is an attempt to win over the public perception that Syria is a good bet.

              But hey, that’s just my thoughts.

                      I honestly have no problem with the background check to buy NFA stuff through a trust as I would be willing to do the background check for any firearm as long as it is reasonable. I would HOPE that they would CHANGE the system to be able to handle the new influx of back ground checks to streamline the system....but I am probably DREAMING. LOL!

                          What you all are not catching it seems is that is not as much to do with a background check loophole as it is to applying CLEO sign off for trust. Some people in certain counties and cities can not get a CLEO sign off.

                          Also the question for me is if I send in my form 4 for a trust how will the finger print cards get completed for my 9 month old. They are opening up a whole new bag of worms with this proposed ruling.

                            You would get denied because a 9 month old would not be able to acquire NFA items (must be 21 to buy from a dealer, 18 to make and register).
