While the import ban is hypothetical, I suspect .223 would be considered a mil ammo since it is so often lumped together with 5.56. For that reason I would also suspect that .308 would be classified as mil until enough hunters raise enough fuss that they do use those rounds for hunting and then the whole thing goes away when a rep pres* is elected in 4 yrs.

* = as long as who ever the reps nominate isnt a moron like perry or palin or a far right winger
