    They can only delay the transaction for 5 days; after that they have to allow you to have the gun if they can't confirm that you are prohibited from owning it.

        "If the FFL has not received from the NICS a final determination after three business days have elapsed since the delay response, it is within the FFL’s discretion whether or not to transfer the firearm (if state law permits the transfer). If the FFL transfers the firearm, the FFL must mark “No resolution was provided within three business days” on line 21d of the ATF Form 4473."

                  Where did you buy it? I didn't get an initial proceed when doing the NICS for my sig, they had 3 or 4 others that had the same happen, they called back for the further reviews on all of us at once and I got a proceed, took 30? minutes start to finish.

                    I think Academy has a policy if they don't hear back, they put the gun back on the shelf.

                    They will not sell due to an omission.

                      The NICS system is screwy IMO, I've gotten initial proceeds, twice at the same shop I've been delayed, and a month later I get an initial proceed.
