Need some advice on a bad deal.

My step-dad is in a bind and I am hoping someone here can point me in the direction to take. He gave cash for a firearm in a pawnshop to the person who pawned it. They were just going to let the ticket expire or whatever happens so he offered to buy it out of pawn.

Being a too trusting guy (and naive), he took the guys word that he would go cash out the ticket and deliver the gun. Well, as you probably guessed, the guy go the cash and has been nothing but excuses. I know it was a stupid move on his part but i was hoping there was anything that he can do.

Is this theft or just an expensive lesson?

Im not terribly familiar how the process works. My understanding is the shop got the gun, he got money and was making the interest payments on the loan. He was just going to quit paying them so i would guess the gun goes to the shop.

I'm 30 and have never pawned anything, but I know the process. Crackheads pawn stolen goods to procure more crack. Don't buy their stolen shit.

Guy pawns gun. Guy decides to let the loan lapse in eccense allowing the pawn shop to own it. Flybye's dad wants gun so makes deal with guy to pay the ticket off in exchange for the guy giving dad said gun when he got the gun out of pawn with money dad provided. Guy took money and dad has not gotten gun.
Hope that helps clarify to those not sure. I am not sure what your dad can do if anything other then small claim court. For future reference the couple of times I have done this I will throw a little change at the guy in exchange for the ticket then go get it out of pawn myself.

your dad basically bought the pawn ticket off the dude....but the dude apparently didnt give up the ticket. Unwise move for your pops, for sure. Can't get the gun out of hock unless you have the ticket. Basically, the dude just got paid twice. Sucks for your dad, but in this case not much can be done.

Small claims court or if you have a lawyer buddy have him write a letter of demand. You'll need some form of proof though, emails, receipts, something. Small claims is cheap and easy to go about.
