  • Felons and Firearms question

Whats the deal on this - is it an automatic ban? Is it for life or a period of time?

I'm not in a place i can research so i'm posing up a question to see if any of you who are bored can answer for me.

Heres the situation - i was let know that a client who was convicted of attempting to murder his wife is in possession of a handgun. Hes playing with it in his office, showing it to people behind closed doors and generally being a fucktard about it. Even if he had the legal right to own one i would be first in line to take it away and pistol whip him about the head for being a moron.

I'm across town and this is 2nd hand info from someone in the office.

A felon in Texas can use a firearm in defense of his/her own home, but can not possess one under Federal law. Catch 22 of sorts.

Either way the clown showing his off is in violation of State and Federal laws.

10yrs after completing his/her sentence a felon can legally own a firearm per state laws, but federal laws say permanent ban. If the person is an otherwise law-abiding citizen and is found to be in possession after 10yrs clean, I highly doubt the feds would pick up the charge.

Was he convicted, served time/probation, or deferred adjudication. Deferred changes things a bit...

There are loopholes, but I don't know them. The charge itself has a lot to do with it as well. If the felony involves violence, the loophole isn't an option IIRC.

Texas has it's own guidelines regarding felons and firearms. Such as an amount of time after a conviction/parole/probation whatever for a felon to possess a firearm and even then I believe it's only on their own property.

However, federal laws say it's illegal.

He served 3-4 years in prison, i do not know if it was federal vs state.

This was back in the 80's. He hired a hit man to take out his wife and it was subcontracted out to an undercover cop. They hid the wife, told him the deed was done and he paid up. Case closed, go to jail.

Can't even trust your hitman anymore, jeez. Subing out the work is putting this country in the mess we are in!

                        lolz

Oh, and in Texas it depends on the crime, and the time that has passed. You can even get your CHL as a felon, if long enough has passed and it wasn't for certain crimes.

Sounds like a really good guy that I would want to be friends with.

Ok ok. Except for antitrust violations, restraints of trade, unfair trade practices, etc. And felonies from other countries. Oh yeah, guns not defined as a firearm by Federal definitions.
