  • what would have happened to me?

    wednesday evening i rode my motorcycle out to kaufman to hang out with a friend of mine & his wife at their house. i just wanted to go for a ride and called him up to see if he was at home, anyways on to the point

    i have my chl and pretty much carry 24/7 except when in government buildings, etc. i took 175 and when i was just past crandall i realized i didn't have my wallet now i usually never forget my wallet but somehow i managed to leave it at home. of course my drivers license/chl/insurance are all in there so needless to say i was driving like an 80 yr old grandma after that. well i rode to his house and back without being stopped, *whew*

    my question is what all could have happened to me if i was to get pulled over? of course i would let him know all the details about how i have a chl i am armed and that i stupidly forgot my wallet at home. after i gave him my info like name/dob/address would my picture come up on his computer? even if it did how much shit could i be in?

    of course i dont plan on ever doing that again, just curious as to what could have happened

    would like to get some LEO responses...

    a dick cop could write you for unlawful carrying of a weapon, same as if you were "printing" or displaying your weapon without cause. but I would think with a clear record and a cool cop you would walk with a stern warning. just my .02, I'm not LEO though.

          Lol, what's the saying? "If you're brown, you're going down"?

          Again, not an LEO, but I would say it would probably range from a night in Lewis Derrick to a stern talking to.

            Does your bike have saddle bags? Could you have put the gun under the seat?

            If so, I would have done this, since there is a vehcle exception now. If you had it on your person, it could be construed as UCW, but "in the vehicle" is not an offense.

            Since you now don't need a CHL to carry a weapon in your vehicle, if you were stopped I would have told the officer I had fogotten my wallet, but here is all of my info. Also, I have a CHL, but I don't have a weapon "on" me.

              Once you provided your DL#, (assuming you know it.) The officer runs a check on NCIC/TCIC it's going to show you have a CHL anyway.

                would be same as driving without your license nothing they run you in computer you come back they tell you not to do that again and everyone splits cop can try and be a dick but not much he can really do

                  You wouldn't have had any trouble out of the LEO's in Kaufman, they have all been really cool when I've had to deal with them. Now Crandall on the other hand I'm not sure about, they used to have a bunch of hardasses on the force there. The kind that would give you a ticket for 63mph in a 60mph on hwy 175.

                    You can carry concealed in your car without a chl, right? Can you not carry on your bike concealed without a chl? Just a hypothetical more than anything.

                        Sec. 46.02. UNLAWFUL CARRYING WEAPONS. (a) A person commits an offense if the person intentionally, knowingly, or recklessly carries on or about his or her person a handgun, illegal knife, or club if the person is not:
                        (1) on the person's own premises or premises under the person's control; or
                        (2) inside of or directly en route to a motor vehicle that is owned by the person or under the person's control.

                          But look at what Tony quoted. You can carry it concealed on you to, from and inside of your car. So IMO you should be able to carry concealed under the same rule on a motorcycle. Now, once he got off it out in public he would be violating the law.

                          I don't know that is how the law is being interpreted by the police and courts, which is why I was asking.

                            honestly, even after reading that, i still wouldn't risk it because as soon as deputy fife decides to pull you off/out of your vehicle for whatever reason, i see the situation going south fast.

                              I would hope it wouldn't be legal for a cop to order you to break the law.
