How do you think the costs are going to play out now? With the officer being investigated, likely charged, and convicted, plus the wrongful death suit that will likely be forthcoming, the costs are going to be far greater than the plead out situation that would have happened with the driver.

Not to mention that the cost to overcome the mistrust of the police will be huge in time and cost.
