    LMFAO I took the boat out this weekend and hit a buddy in the head with a beer as i was tossing them to him from the marina dock. he didnt fall in though.

          Not sure about Texas, but in California there is no open container law on a boat and the operator can be drinking, but is subject to the same .08% law as operating a car.

              yea i was out on the California delta when i was a senior in high school on my boat with some friends. went to meet up with some fellow students for a party on a houseboad on the sacramento river. 5 minutes before we got there a girl was swimming and didnt tell anyone and decided to use the outdrive instead of the ladder to get onto the swim platform. lets just say that didnt end well for her leg. It was nasty.

                Yeah, I asked the same question. I'm fairly sure in TX boater ed it used the term operator a bunch. I posted up here about "what if anchored..." and all that jazz. In regards to that, it generally was agreed that a legal operator had to be sober.

                Just looked this up (because I needed to be sure)...

                Open containers are legal, but operators of boats are subject to boating while intoxicated laws, similar to driving a vehicle. Operators or passengers may also be subject to public intoxication laws. Drinking and boating is DANGEROUS and the cause of most boating fatalities.
