He shouldn't have been there in the first place, but consider if you ended up in that situation (such as coming home and parking near the party). I would NOT retreat to my house -- they could charge you from behind or pull a gun themselves. After all that...there's now an entire party that knows where you live and has time to prepare (obviously, they were a pretty stupid bunch). I would backup slowly but not get cornered. He was right to fire, but not right to instigate.

My only issue is what can you give this guy for instigating the situation? You can't take his CHL away...I mean you CAN...but should you? I can't decide.

The gun part itself shouldn't bother anyone. With a CHL, it's typical accoutrement whether you are asking your neighbor for a cup of sugar or to turn their music down.

SECTION 5. (a) Sections 9.31 and 9.32, Penal Code, as amended by this Act, apply only to an offense committed on or after the effective date of this Act. An offense committed before the effective date of this Act is covered by the law in effect when the offense was committed, and the former law is continued in effect for this purpose. For the purposes of this subsection, an offense is committed before the effective date of this Act if any element of the offense occurs before the effective date.

(b) Section 83.001, Civil Practice and Remedies Code, as amended by this Act, applies only to a cause of action that accrues on or after the effective date of this Act. An action that accrued before the effective date of this Act is governed by the law in effect at the time the action accrued, and that law is continued in effect for that purpose.

SECTION 6. This Act takes effect September 1, 2007.

Should have left the situation to avoid any escalation, only if there was no possible way out for him to escape safely did he have enough reason. Don't get me wrong, no compassion for a dumbass charging someone with a gun(and knows full well he has one), but the lawyers will have a field day on this case.

This guy is going to feel really fucking stupid the moment the cell door closes behind him forever. He's going to realize that had he just kept his dumbass in the house it all could have been avoided.

I'm wondering what history he has with his neighbors that made him think he needed to go outside to deal with this situation. I wouldn't think this would have been the first time they have had words. Both sides seemed way too mouthy to not crossed paths before.

Probably a nosy neighbor that has complained before(not saying without reason) and the noisy drunks have told him to go fuck himself several times before.


Either way, if you're timid and don't know when/if the right situation to use deadly force is(and more importantly how to avoid getting yourself in those situations), you don't need to be carrying.
