It's not like they "lost" in this situation. You can get the info you need without him answering the question. If you can get someone to speak, you can get a smell of breath. You can get the same breath with a standard answer, or his "name and badge number" routine. If he doesn't smell drunk, and doesn't look drunk (eyes, appearance, etc), then he goes about his way. Simple as that.
It's the totality of the circumstances, not the answer to the question.

If you have the misfortune of going through one, you are not accomplishing ANYTHING by being a douche to the cop. He could have said no and been out of there a minute earlier. Refusing to answer the cops questions is not going to stop random checkpoints from being used, and I'd be willing to bet that this guy has not made any effort to address his displeasure with the procedure through the proper channels to try and get this policy changed.
Sure, this guy exercised his rights not to answer, but what did it accomplish? If he would have smelled of booze or slurred on any one of his questions, he would have been out of the car with a quickness. If the cops really wanted to be dicks, they would have just said they smelled booze for not complying with them, and later say he failed or refused a field sobriety test.
Hooray for sticking it to "the man" er.... being a douche and changing nothing.

I don't give a shit. I'm tired of people pretending like shit like this is okay, all in the name of some supposed unspecified benefit. There is no probable cause, it is completely against the very basic founding principles of this country we live in. Pretending like it isn't a big deal is fucking stupid, and so is anyone that thinks otherwise. How about some random home checks while we're at at it? Get the fuck outta here. It pisses me off, and should piss anyone with half a brain off.
