Absolutely not. As said above, he had a reasonable opportunity to escape and he purposely chose not to take it. He knew or should have known that the guy that jumped on and punched his car and that was yelling and following him down the street would come after him if he stopped and got out. He clearly got out for the purpose of knocking some heads out of the park with that bat. Don't get me wrong, I love that he dolled out some serious street justice, but he's guilty as sin.

So if when he drove to the end of the street, and got out to look at his car, that when all 7 of them ran up on him screaming threats and fully intent on doing him bodily harm, that HE would have been the one who "attacked" them?
