    there is no way to prove the kid was still alive or dead after the first shot to the head. the guy might have said he saw him moving but it was probably just nerves. not many people survive a gun shot to the face.

    the jury is in the wrong here for assuming the robber was still alive after he was shot in the head. there is no way to prove it beyond a reasonable doubt.

                Sad, but the was a moron. You do not shoot a fleeing suspect no matter how upset or frightened you are. You will go to prison. This guy should have taken a CHL class. A little bit of education would have gone a long way for this guy.

                  What video are you watching? He didn't shoot a fleeing suspect. Dude shot was still in the store.

                    I only watched the video until 2:20, but that should be enough I'd think. I did not watch the rest so my opinion would be swayed.

                    1. The 16 "kid" pulled a gun and pointed at someone with the intent to use it for a crime. My personal opinion is that he had it coming.

                    2. The second set of 5 shots were not called for *from what I can see on the video*, however - I can't see it being "murder" given the circumstances.

                    3. How is it when someone pulls a gun on you, to commit a crime and you kill them - you go to jail for life? I see "46 seconds" mentioned a lot there, and I can see how in that situation 46 seconds may seem like 5.

                    4. I feel if I pulled a gun on anyone, anything that happens is my fault - specifically when doing so as a criminal!

                    5. Why is the family so happy the man got a life sentence? If that were my kid - I THINK - I'd be extremely sad at the situation as a whole (actually hysterically upset, probably insane). I may even hate the shooter, but as a parent I'd have to realize that *I* failed my child for getting shot for being an idiot at 16.

                    Either way, I think the justice system made a mistake this day. Remember, he came in there with a fucking GUN - not a baseball bat. That man went into the standard fight/flight mode and chose to fight and won.

                    I understand the technicalities that are being pointed out, but murder?

                      I'm sure the jury was specifically asked to focus on the technical act if it was murder or not and to not focus on the situation or sentence.

                      Murder - Noun:The unlawful premeditated killing of one human being by another.
                      Verb:Kill (someone) unlawfully and with premeditation.
                      With this definition I find him not guilty. It was not premeditated and it was not unlawful.

                                The secondary round of gun fire was foolish. You end the threat and then give aid if you can. Had he grabbed a towel and attempted to render aid he would have never seen a court room.
