I think you may have misinterpreted what he said. If you read sexual assault in the texas penal code, it specificly mentions sexual contact with a child. Child is defined as anyone under the age of 17.
There is an affirmative defense to prosecution if the actor is within 3 years of age of the possible victim and the victim is 14 yoa or older. Example: This means if the person is 15 yoa and an 18 has consentual sex with them a charge can be filed if the parents want to prosecute but will get thrown out once it goes to trial. 17 is 17 in texas and the legal age for consentual sex.
