      If he's standing in someone else's yard (which the cop insinuated), that could be trespassing. Was the cop wrong? Absolutely. Did the guy bring it on himself? I think so.

          As an attorney, I would try to keep the attention far away from the fact that Crook initially said no to the cop's question of his residence.

          I would focus most of the court's attention to the officer's report.


          In his arrest report, Colling wrote that Crooks grabbed his shoulders "and attempted to take me to the ground. I in turn took him to the ground."

          It is pretty obvious that the doucher, cameraman did not try to take the cop down.
          The officer has blatantly lied in his report. His credibility is shot. His previous issues can now be evidence for his inability to perform as an officer of the law.

            Typical cop IMHO

            You give a guy a badge, a gun, a cop car with blinky lights and unlimited free lunch at fast food joints and they think they run the place. Is anyone really surprised?

              Only if the yard were posted or the owner had told cameraman to leave. If my neighbor stands in my yard he isn't trespassing because I don't care if he is there, that is, he has my permission. The trespassing thing is what happens when you are a cop, get your feelings hurt and start beating on someone without thinking. He realized he better start making shit up. It didn't work, that is why he got suspended.

                The guy is lucky the vid caught that or he would be locked up now . What if he was a guest and didn't live there ? Total over reaction without probable cause by the leo . The dude was being a dick but thats not a crime .

                  I seems that people always want to "test" their rights against cops then cry foul when the cop reacts. We need to remember that cops risk their lives everyday for people. Most of the situations that they come up on they have no clue who or what is involved. They have to approach every situation like their life is in danger. People need to be respectful of that and not test them at the wrong times.

                    You must give cops attitude then, majority of the cops I've run in are easy going relaxed guys. Theres always the one who acts a fool though

                      I agree , BUT , there were 2 other cop cars there already and this guy was across the street not even making contact . I think there is a way we exspect them to act (logical and in control) and this is why we let them walk around with loaded weapons . I have a different oppinion on lots of these situations because I have had a run in with a leo like this one in the past and luckily he showed his ass at the right time and it was on video .

                        Its attitudes like this that have us in the situation we're in now, with cops running amok.

                        Every situation is different and doesn't require a "shoot first ask questions later" mentality. The guy has a right to shoot film and the cop got butthurt when he told him he wouldn't stop filming. It's high time the overzealous cops were reigned in and brought back down to reality. They can't do whatever they please, even though they think they can. Technology is awesome! There was a time that it would have been this guys word against the cops, and he'd still be sitting in jail now.

                        EVERY interaction with law enforcement should be at a minimum sound recorded because of incidents like this, and don't rely on the recorders on police, or in their cruisers either. You'd be surprised how easy it is for stuff like that to get "damaged."

                          I agree with all of it, BUT guys have to realize that to make a point (and proclaim their "rights"), they just might take an ass-whipping. From that point of view, I don't really feel sorry for the camera man. The cop was 100% wrong.

                            The way I see it, he overstepped his bounds trying to beat some respect into that guy. They should make an example out of that cop, he should be fired and charged for assault. The problem is that if a random stranger walks up on to your yard and takes a swing, you can fight back. When a cop is having a bad day and does it, you can't do shit about it.

                              His countersuit isn't about making a point, its about a payday. I mean granted the cop went over board but he was ASKING for trouble. RIght when he said he didn't live there.

                                I found out after my incedent that the officer did not have a camera in his cruiser and was told by my lawer that he would not ride with one . This after reviewing a file 5 inches thick that my lawer had on this one leo . He lied on the stand , under oath , and this is why my case was dismissed . Not fun to be out alone at 2 am with a guy like this and no one around . I can honestly say if I new then what I know now it would have been a very different story .
