From pool code:
1. Fence shall be constructed or retrofitted to comply with current code requirements.
2. All fence gates that are not easily retrofitted to meet code shall be locked with a pad lock at all times.
3. All existing horizontal members that are less than code height requirements shall be retrofitted so as to not allow for climbing over the fence. Members shall be constructed to form an angle on top as to not provide a step
Fence code has no specific sections addressing pools.

The pool currently has a fence around it (can be seen in picture), but I was wondering if just having the back yard fenced in met the requirement for the pool fence.

Most of the cities have gone to the national code for pool safety fences, you have to be careful and read them thouroughly.If you build a privacy fence and the good side faces in toward your house you have to put no climb boards on the rails.Most of the time the pool people I work for and the builders use 5' tall iron fence with spring loaded gates which also gets the latch up to the required 54"s the larger drive through gates you put a pad lock on them all gates must open away from the pool chainlink will not pass period.When you get a permit the city will usualy come out and do a inspection after the fence is constructed.
