Under that theory, there would be many thousands more of machine guns in households. Seems to me you’d have an automatic defense to prosecution for attempt to pay the govt but they refuse and their refusal could not lead to charge against you...but you don’t because it doesn’t exist.

Edit: There are more machine guns in the USA that are not on paper then are on paper and that is not my opinion, that is the opinion of the ATF. They do not worry about it and only do anything about it if they are found in conjunction with another crime or if they are being trafficked/sold. Until DHS was formed the ATF was not even considered an agency with LE powers. They were just a regulatory agency that collected taxes on the 3 things that are in their name.
