Looking at it again you might be right. It could be argued either way. However, second degree murder or felony murder sound about right.

Sadly, the example they give for 2nd degree murder is a little too on the nose in this instance.

I know Kate was only hit once, but where does it say he fired the gun three times? Did anyone see that the maximum penalty for the charge he was convicted on was three years and he has already served two.

He won’t get the max penalty. That’s reserved for minor drug offenses.
