  • Japan's top court has approved blanket surveillance of the country's Muslims

    Japan's Supreme Court has upheld the government's blanket surveillance of the country's Muslim community.

    The court struck down the second appeal by Japanese Muslim plaintiffs against what they perceive as an unconstitutional invasion of their privacy and freedom of religion.

    A 2010 leak of 114 police files revealed nationwide surveillance of Japanese Muslims. The files revealed that Muslim places of worship, halal restaurants and Islam-related organisations across the capital, Tokyo, were being monitored.

    Within a few weeks of the leak, the data had been downloaded 10,000 times in 20 different countries from a file-sharing website.

    A group of 17 Japanese Muslims, mostly from Middle Eastern and North African countries, decided to sue the Japanese government for infringing on their constitutional rights.

    Mohamed Fujita, a native of Japan who converted to Islam over 20 years ago, is one of the 17 plaintiffs fighting the surveillance.

    He told Al Jazeera: "They made us terrorist suspects, we never did anything wrong - on the contrary."

    The Supreme Court finally dismissed the case after two appeals on 31 May.

    The plaintiffs were awarded ¥90 million ($880,000) as compensation due to violation of their privacy by the leak.

    However, the presiding judges did not make a judgment on police profiling and surveillance tactics which a lower court had upheld as "necessary and inevitable" to guard against international terrorism.

    A lawyer for the plaintiffs, J unko Hayashi said: "We were told we don't have a constitutional case, we're still trying to figure out how it is not constitutional."

    Speaking at a Tokyo symposium on government surveillance via weblink, NSA Whistleblower Edward Snowden said: "People of the Islamic faith are more likely to be targeted... despite not having any criminal activities or associations or anything like that in their background, simply because people are afraid."

    At last some Government and Jurist in the world have realized that islam is not compatible with a free society and is taking steps to prevent problems. I wish that way of think would make its way over here.

        No they aren't. No one deserves to be treated like a criminal just because of their religion. I believe in profiling to stop crime, but this kind of law is no better than the Japanese internment camps.

            And when you hear shit like one of the Paris attackers being sheltered and protected in Molenbeek.... For months .... By all the moderate Muslims .... You can see how the Japanese can come to these conclusions.

              Exactly. Let's say there are only 5,000 "bad" Muslim terrorists in the whole world. There are still over 1 billion in their terror support network that feed, shelter, protect and lie for them.

                And this is why the left calls the right bigots and racists. Yes, most terrorists are muslim, but not all muslims are terrorists. Many, probably most, are actually peaceful and law abiding. I don't support bringing in refugees and I don't like how the fbi is scared to investigate a legitimate complaint against muslims, but if you believe in things like the 5th amendment then this kind of thing is wrong. Either you get protected rights for everyone, or we amend the constitution to get rid of rigts for anyone. Pretty simple.

                  This guy gets it. All of us are in a bind, we play by rules and the terrorists don't. If we throw out the rulebook to stop them, then there is nothing to stop the government from doing it to us.

                    True, but let's not forget that it's not only terrorists with bombs and guns.

                    Their daily culture involves subjugation of women and non-Muslims, murder of gays, death of apostates, etc. I mean this is a shitty barbaric culture. You just can't have that around the Japanese. It's not very Feng Shui.

                      I agree with you on 5th amendment rights for Americans, although I think you meant to say the 4th amendment. We need to profile those likely to be terrorists or giving safe harbor to them, but there needs to be probable cause to go further such wire taps and search warrants.

                      And why are you arguing either amendment, when Japan doesn't have one?

                          All of this. No one deserves to be treated like that because of their religion, race, sex, etc. until actions prove you should be, and that's on an individual basis. What needs to happen is that he peaceful Muslim community take a hard stance against the jihadist action and ISIS. Oh, and every citizen should be armed, trained, and ready to dispense justice on anyone infringing upon our rights at any given time. Potential victims don't usually have the ability to shoot back...

                            Being peaceful does not mean that they do not agree with the Jihadist.
