That's exactly where this will end.

The somersaults of statutory interpretation they have performed (“penalty” means tax, “further [Medicaid] payments to the State” means only incremental Medicaid payments to the State, “established by the State” means not established by the State) will be cited by litigants endlessly, to the confusion of honest jurisprudence. They had to uphold it, it would have been a disaster if they didn't.
It really doesn't change much, the system will collapse on rate changes any way. It'll never be repealed now.
IMO the Republican's need to change course on the issue. They need to basically acknowledge that the electorate had demanded it then outline how they will fix it so it actually works and reduces healthcare costs.
However, there is no way the ideologues will go for that.
