          I didn't say that I was drunk nor do I condone drinking and driving.

          My wife and I decide who is drinking when we go out. So, if I get pulled over for a traffic offense and the officer asks if I have been drinking, I won't answer that question nor any other question.

            That's really easy to say and it's not a bad idea but you'll likely still get to spend time in a drunk tank while your paperwork gets processed.

              It is ok. I am not willing to give up my right to remain silent even though other people may feel like they have to give up their 2nd, 4th and 5th amendment rights to appease police.

                      I know my rights but given the choice of a roadside sobriety test and heading home or being booked and blood drawn I'm taking the roadside test. Or if I really am drunk I'm taking your route and calling an attorney the first chance I get.

                          Breath test is for bac, sobriety test is for anything that may be impairing that will not show up on a breath test.
                          Why don't they jump straight to it when you smell like you work at a brewery? No idea.

                            I'm going to guess that not every officer carries a breathalyzer, just like not all of them have speed enforcement equipment. Your average beat officer has better things to do than deal with traffic enforcement.

                              Everyone has their own choice to make. I'll rely on that the police won't be able to articulate reasonable suspicion based on non-answering.

                                I'm trying to understand, Richard. I believe e all know our rights or at the very least understand them. If you and your wife and have come to an understanding as who drinks and who drives, isn't it only logical if you get pulled over to not just answer his questions and be on your way?
