That's what makes it an atheist.

Webster's defines atheist as: one who believes that there is no deity
And I and jluv have both provided definitions from different sources that includes the above, but extends it to other atheists who just don't believe.

if you are a person who only only believes in scientific evidence, and you have no proof that god exists and no proof that god doesn't exist, you don't believe in either

to accept that there may or may not be a creator does NOT MAKE YOU AN ATHEIST
      It does, by definition.
Scientists do not coddle ideas. They crash test them. They run them into a brick wall at 60 miles per hour and then examine the pieces.

If the idea is sound, the pieces will be that of the wall.

        It does, by definition.

We now have 3 definitions that state that not believing in a god/s is atheism.

have you come to the realization that this is all theoretical and you can neither be right nor wrong?

If it's theoretical, then the answer with the most evidence is going to be assumed to be the correct one. So, as we have a total of 4 sources of the definition of atheism, 3 states that not believing is the criteria and one states people must believe at no god exists I've no reason to assume that there isn't a right answer. Especially when the evidence suggests that the answer I have is the right one.
