  • GOP Rep proposes repeal of 16th Amendment

    A Republican congressman has filed a bill to repeal the 16th Amendment, which allows the federal government the authority to collect an income tax.

    Oklahoma Republican Rep. Jim Bridenstine wants to repeal the amendment in order to scrap the complicated federal tax code, get rid of the income tax for individuals and corporations and abolish the Internal Revenue Service.

    “The 4th Amendment to the US Constitution guarantees ‘The right of people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures.’ The 16th Amendment effectively negates the 4th Amendment,” Bridenstine said in a statement. “The 16th Amendment should be repealed and the IRS should be eliminated.”

    “Viable alternative plans for raising revenue fairly to support constitutionally enumerated functions of the federal government have been proposed,” Bridenstine said. “As long as the 16th Amendment is in place and lobbyists dominate Washington, these alternatives will never be considered.”

    Bridenstine himself favors the “fair tax,” a kind of national sales tax.

    There has been talk of Congress moving forward with tax reform. Senate Finance Committee Chairman Max Baucus, a Democrat, is working on a tax reform plan, as is Republican Ways and Means Committee Chair Dave Camp in the House.

    This will never happen, and it's fucking stupid to even propose it. I'd like to hear how they justify to themselves that the 16'th violates the 4th.

      Because the IRS, without a hearing, may seize your property and imprison you until they get around to a hearing. They may close your business and we've seen the IRS go after political opponents.

      Will never happen? We need 3/4 of the states. You think 3/4 of the states aren't tired of paying federal income taxes? We don't need any congressional approval at all for an amendment.

        Won't happen. I would rather everybody pay a flat sales tax then dick with the irs but I don't see them passing that either.

              That`s right! The IRS Agents will just show up at your home one day, call you a dead beat, and do all kinds of bad things to you for no reason other than being a name they drew out of the hat because they needed someone to practice their tourture on because business was too slow in the office.

              Which 3/4th are you talking about there? Are you talking about those half of the states that get more *BACK* than they send in? All the while screaming Washington is broke?

              I dont see that happening. The good God fearing Republican States of MS, AL, LA, OK, AR, etc will never practice what they claim to preach and vote for something that takes away their "gravy train"

                This thread makes my head hurt. 1/2 and 3/4 are different numbers and there is not national sales tax.
                I don't like Republicans, but I really FUCKING hate Democrats.

                  No right now the sales tax has nothing to do with the federal government. If the made it a federal flat rate sales tax you could eliminate the IRS and generate more money. The people who spend more will pay more which generally would be the higher earners. More than one study has shown this is a better system then what we have now, I'm sure we can all agree that what we have now isn't exactly working.

                      Flat tax percentage on everyone, rich or poor- no deductions, no credits, no loopholes.

                            It's the best you could reasonably hope to get under the current political system, and would be far better than the current hodgepodge of tax laws. Granted laws can be changed, repealed, etc., no argument from me there.
