    Warning: VERY harsh language. The two arrested were allegedly only carrying antique black powder revolvers. The crowd turns on the police in a non-violent, but verbal dress-down of epic proportions.

    Under Texas law, a gun manufactured before 1899 is not even considered a “firearm,” therefore not subject to open carry laws:

      Sounds like an easy way to go to jail, all the same. Also, I kept hearing, "replica." If it's a black powder replica, but made after 1899, where does it stand legally?

              46.01 (3)(A) & (B)



              (3) "Firearm" means any device designed, made, or adapted to expel a projectile through a barrel by using the energy generated by an explosion or burning substance or any device readily convertible to that use. Firearm does not include a firearm that may have, as an integral part, a folding knife blade or other characteristics of weapons made illegal by this chapter and that is:

              (A) an antique or curio firearm manufactured before 1899; or

              (B) a replica of an antique or curio firearm manufactured before 1899, but only if the replica does not use rim fire or center fire ammunition.

                  Texas open carry demonstration nearly causes riot

                  From the Gun Control Act of 1968 (Which modified Title 18, U.S. Code):

                  18 USC 921 (a)(16).

                  (A) any firearm (including any firearm with a matchlock, flintlock,
                  percussion cap, or similar type of ignition system) manufactured in or
                  before 1898;
                  or
                  (B) any replica of any firearm described in subparagraph (A) if such replica --
                  (i) is not designed or redesigned for using rimfire or conventional centerfire fixed ammunition, or
                  (ii) uses rimfire or conventional centerfire fixed ammunition which is no longer manufactured
                  in the United States and which is not readily available in the ordinary channels of commercial
                  trade.

                  FTP beat me to it, but I believe texas has a different definition under their state laws.

                    If those were true replicas, then the two arrested will get paydays and absolutely nothing else will happen. Unless the law changes, or society gets so bad that people will open fire on cops like that, it's going to continue.

                        NOt sure what they were charged with , But I'd bet they end up with criminal trespass charges. They were asked to leave the property and refused..I bet their arrest is not related to the gun charge at all...

                              False arrest for starters. They got arrested for open carrying a replica of a pistol made before 1899. If it's a true replica that fires a ball, then they had no right to arrest them. If it's a replica that uses modern ammunition, then they don't have a leg to stand on and good job to the officers.
