Breaking: Obama condemns IRS at 830pm

    We already knew last night that he was planning to leave, rendering O’s big IRS scalp-taking a joke, but what we didn’t know for sure was whether the White House was aware that Miller was inching towards the exit.

    Answer: Yep, they were. His term is actually limited by statute.

    Miller, a 25-year career IRS employee, was appointed acting commissioner on November 9, 2012. According to the Federal Vacancies Reform Act of 1998, his 210-day term would have set his last day in that post as June 8.

    This does not mean that Miller is not paying a price. His intention had been to go back to his job as Deputy Commissioner for Services and Enforcement, a position that put him in charge of the tax exempt unit at the center of a scandal over targeting conservative groups.

    This statute makes it clear Miller could not remain acting IRS commissioner unless he was proactively reappointed as acting commissioner for another 210 days, or Obama nominated a permanent commissioner allowing Miller to remain in the job until that person was confirmed.
    I’m not sure why ABC thinks Miller’s resignation means he’ll be “paying a price.” With 25 years of experience, he’s primed for some sort of nonprofit lobbying job where, no doubt, he’ll make much, much more than he does now. And that’s assuming that he’s not quietly rehired by the IRS at some point once the current storm has blown over. Remember, four State Department officials ostensibly were punished after the Benghazi attack last year by being placed on leave, only to land at other jobs at State. Just yesterday, The Cable quoted a source as saying Susan Rice, despite having been too radioactive to pass Senate scrutiny for secretary of state, “definitely” is in line to replace Tom Donilon as Obama’s next National Security Advisor. They’ll find room for Miller somewhere once it’s kinda sorta acceptable again for them to do so. One footnote, though: I’ve seen a bunch of people on Twitter treating Miller as a fall guy in all this because his term as acting commissioner didn’t start until last November, long after the harassment of tea-party groups began. That’s fine, but Miller found out last May, when he was a deputy commissioner, what had been going on and he said nothing. Don’t cry too hard for him.

    Anyway, and needless to say, this not-so-minor detail about Miller’s imminent departure was conveniently omitted from Obama’s big house-cleaning press conference last night. Oh, and he emphasized today that he knew nothing about the IG’s report on the IRS’s anti-conservative practices, which isn’t quite the same as saying that he knew nothing of the practices themselves. Be on the lookout for lawyerly precision.

    Update: I take it we’ll find out tomorrow that this guy has been planning to retire for six months.

    An internal IRS memo says Joseph Grant, commissioner of the agency’s tax exempt and government entities division, will retire June 3. Grant joins Steven Miller, who was forced to resign as acting IRS commissioner on Wednesday.

    As part of his duties, Grant oversaw the IRS division that targeted tea party groups for additional scrutiny when they applied for tax-exempt status.
    Grant wasn’t the commissioner of the tax-exempt division, he was the acting commissioner, just as Miller was the acting commissioner of the entire agency. Does that mean he’s term-limited too and was on his way out anyway?

    Update: You can’t be serious.


    Was he promoted from acting commissioner to commissioner, or from some lower rank to acting commissioner? I can’t find any personnel announcement online. The distinction is important, as one suggests this is a legit scalp-taking and the other suggests it’s a farce. If he was installed as permanent commissioner only to “retire” now, then obviously he was pushed out against his wishes. If he was merely promoted to acting commissioner, then it looks like he was elevated for the purpose of taking the fall. If anyone has a link, please send it.

        OK, I just looked into the dates of his position. Joseph Grant (second guy forced out) wasn't in the position during the alleged timespan. It was Sarah Hall Ingram, who is now in charge of enforcing Obamacare through the IRS.

        So that is now TWO top IRS officials that weren't in these positions of authority during this scandal. Brilliant.

          The President couldn’t even bring himself to breathe a word of the truth.

          He could fire some hapless Acting Commissioner, but last night Mr. Obama never came close to discussing that which must never be discussed.

          The IRS?

          It’s about a union: the National Treasury Employees Union. The NTEU. A left-wing union representing 150,000 employees in 31 separate government agencies, including the IRS. A union that not only endorsed President Obama for election and re-election, but a union whose current president, Colleen Kelly, was a 14-year IRS agent and now is both union president and Obama administration appointee (of which more in a moment).

          It’s about 94% of NTEU union contributions going to Democrats in the Senate and House in 2012 — candidates who campaigned as vociferous opponents of the Tea Party.

          And the recently released report from the Treasury Inspector General? You will not find a single reference to the NTEU. Whose members are both player and referee in the exploding controversy over the IRS targeting of conservative groups.

          Which raises the obvious question: how many NTEU members were involved in the writing of the Inspector General’s report?

          Even more to the point, what contact — what coordination — has the Obama White House had with their allies in the NTEU leadership as both the White House and the NTEU race to get on top of a scandal that is rapidly engulfing both?

          Did I mention that the NTEU has no comment on all of this? And that when President Obama went in front of cameras to make his statement on the IRS scandal — he never once mentioned his very powerful union buddies that have the run of the IRS? Right down to the control of who gets a Blackberry? Literally.

          Let’s first see how the IRS/NTEU game with the Tea Party and conservatives is played, shall we?

          In the 2012 election cycle, the IRS union gave its money this way:

          For the U.S. Senate:
          Total to Democrats: $156,750
          Total to Republicans: $1,000

          For the U.S. House:
          Total to Democrats: $391,062
          Total to Republicans: $23,000

              In no uncertain terms and with no hedging, The New York Times reports that the Obama administration was aware of the fact that the IRS was targeting Tea Party groups as far back as June of 2012. The Treasury Department's Inspector General confirmed that he told senior Treasury officials in June of 2012, a full five months before Election Day:
              The Treasury Department’s inspector general told senior Treasury officials in June 2012 he was investigating the Internal Revenue Service’s screening of politically active organizations seeking tax exemptions, disclosing for the first time on Friday that Obama administration officials were aware of the matter during the presidential campaign year.
              We still don’t know for sure what the President knew or when he knew it, but this does confirm that the administration was aware of the fact that Obama's political enemies were under fire by the IRS and covered that fact up during an election year.
              As Lisa Meyers of NBC News told "Morning Joe" today, "Imagine if we -- if you can -- what would have happened if this fact came out in September 2012, in the middle of a presidential election? The terrain would have looked very different."
              The first time President Obama was asked when he found out about the IRS scandal, he told the media that he learned of the news last Friday, the same way the rest of us did -- from the news media.
              Thursday, a Bloomberg reporter asked the President when he or anyone else in the White House learned of the scandal. The President dodged the question.
              With this latest news confirming when the Administration first learned of the IRS scandal, we now know that, along with Benghazi and the unfurling Associated Press scandal, there were three scandals brewing and unfolding in the White House during an election year. But we are only now hearing about them -- six months after Barack Obama was safely re-elected.
              This fact says as much about the failure of our lapdog national media as it does about President Obama. Why just this morning the Times itself dismissed the IRS scandal on its editorial page.

                So when the old "It's Bush's fault" thing doesn't work out or they know isn't applicable, they know play stupid with the American public. Funny how that works out from a man who claims the buck stops with him........
