      I also agree. As much as I see this ass-clown as a muslim terrorist, he is a sworn American citizen. It would make me a straight-up hypocrite to think any other way.

        And that is how the Constitution works. Doesn't matter what you're accused of, you get due process. If he was an illegal or even just not a citizen, zero protections, enjoy Cuba. The congressmen calling to call him anything but a criminal to be prosecuted by a civilian criminal court need to step down

          It is actually really easy to stop the Muslim terrorists from doing anything against us, but it will take balls which the libs and most conservatives don't have. Right before killing one of the terrorists, we need to kill a hog and rub the blood all over bullets used to kill the terrorist. We need to video tape that and put it all out there so all the terrorists can see that if they mess with us, they will not only die, but they will NOT go to heaven in their book, and they will NOT get their virgins.

          That would put a stop to them messing with us.

            This is one of the reasons they kept him in a sedated state. Now that they have established this, they can properly Mirandize him. They also did it to keep him from communicating anything to anyone else, like hospital staff.

                I was under the impression that if it was against their will, the whole pork thing didnt matter.

                  Yep, because the Constitution says it only applies to citizens and in the 5th amendment doesn't state: "No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."

                    As of 2003, it's been determined by the supreme court that the 5th and 8th amendments do not apply to enemy combatants "held abroad".

                      Technically the Constitution does not apply to citizens or non citizens... It applies to the Federal Government.

                      I do have trouble with the thought process that our laws apply to non citizens.

                      Granted in this case we are talking about a citizen. But non citizens should not be offered ANY protection from our laws

                        I agree. That decision was based on the GITMO situation. I'm not sure about an American citizen carrying out an "act of terrorism" on our soil.
