    No, they can't. They can rule on new laws but any law that expands the federal government beyond the Constitutional boundaries is unconstitutional despite what a court of unelected judges decides.

          This is probably where they infer the authority to subpoena; kind of hard to hold a tribunal if you don't have any accused/witnesses to hear from. Without the ability to subpoena, a tribunal would really just be another session of Congress.
