Exactly. That's kind of the point. The federal government has 18 enumerated powers and anything that the States decide to allow by amendment. If it's not enumerated, the power does not reside in the federal government. It belongs to the states and the people respectively.
OSHA? Unconstitutional on a federal level. Same with minimum wage, EPA, DEA, Dept of Education, Energy and so forth. You said if a bill is passed it's defacto constitutional, yet when I presented you the most blatant example of how wrong that is, you change your argument.
