It's probably a bit of both. The Constitution IS the end all as far as federal powers. The SC has acted in violation of their authority repeatedly as has congress. We would be 100% within our authority as citizens to remove them all and replace them with those who would honor the Constitution. The SC isn't even supposed to have a life long membership. That's one of those things that were decided was best without constitutional authority.
One more thing. The Supreme Court DIDN'T strike down internment. They upheld it in 1944. From what I'm reading, it's still on the books that internment is legal.
On December 18, 1944, the Supreme Court of the United States clarified the legality of the exclusion process under Order 9066 by handing down two decisions. Korematsu v. United States, a 6–3 decision, stated that the exclusion process in general was constitutional. Ex parte Endo unanimously declared that loyal citizens of the United States, regardless of cultural descent, could not be detained without cause.
