  • Chief Justice Says Following Constitution Not Important



    Chief Justice John Roberts says in his opinion that the Interstate Commerce clause doesn't authorize the mandatory health insurance provision of Obamacare but that following the Constitution isn't important so long as the Chief Justice is in political agreement with what Congress wants a law to do.

    Chief Justice Roberts has apparently forgotten that the Supreme Court's only authority to act is as a legal body. It is not a super house of Congress with the authority to correct what individual justices believe are errors in acts of Congress. The Court is supposed to base its actions on the Constitution rather than on the personal political opinions of the Justices. It is not the role of the Court to determine if a given act of Congress is desirable or not. That is the role of government officials who are elected by the people.

        That's absurd, but I'd like to see that verbiage in his written opinion as opposed to paraphrased on some completely obscure blog before I take it as gold.

              I personally think Roberts is about 10 steps in front of everyone else with this. He has established it as a tax. He has also instructed the American people if they give a fuck enough to listen that only they can repeal it with their votes this November and if they don't, they get the government they allowed to be voted in and therefor the tax stands. This is an all or nothing election. We have to get the super majority Democrats enjoyed from 2008 to 2010 and don't waste time repealing the shit. The vote is coming up in the House and it will pass. Then it needs to hang tight until the elections before being voted on in the Senate. If the Republicans win, the very first thing they will vote on is the bill which has already passed the House even if the Democrats ended up winning it back. All thats left is Romney to sign it.

              Roberts took a gamble on America. Let's hope it pays off.

                  So it's a problem that he acknowledged a political reality, then laid out how that mechanism works, then gave us the means to fix the problem? Sounds like he really knows where his towel is at.

                    I think if he was 10 steps ahead of everyone, he wouldn't have taken a chance for this to be corrected down a chain of at least three ifs and maybes while thumbing his nose at the Constitution.

                      It will take more than that to overcome the filibuster. However I don't even think the Republican's will get control of the Senate.

                      IMO the only thing we can do in reality is to either kill all funding for Obamacare or go about fixing it, piece by piece, to something that makes sense.

                        Obamacare/less money the government lets us keep is here to stay. Even if the Republican party could get rid of it I don't believe they have any real plans to actually do it. All the majority of them care about now is getting there people in places to get a piece of the pie. I hope I'm wrong, but I just don't see any reason that would make me feel any different. This is the same party that gave us TARP, the Patriot Act, the TSA, ect...

                          From my understanding, since this is a budget issue (tax) it can be repealed by reconciliation which only requires 51 votes. You can't filibuster this
