I'm far too lazy to read that whole article. Why did the EPA say they couldn't build a house? Where were they trying to build it, the middle of some national park or something?

Tax cases go through the United States Tax Court. It is under legislative control instead of judicial, which can create a host of issues (those that tax us, appoint and pay those that judge us)

Not entirely true. A TP can pay their assessed liability and sue through the US District Court or US Court of Claims.

And you can say that it creates a host of problems, but it also creates a lot of opportunities. Each of the District Circuits has a pretty distinct pattern of how the rule on tax cases (5th being one of the most TP friendly, and the 9th generally being the least; no shock on either one of those).
