Actually, I have the same question about this as was raised about the law that says an officer can stop for the sole purpose to determined if the driver has a licence to operate a motor vehicle.
Why don't you research this and see if there is any case law against that statute?

Oh, and there was no judge involved, just a Municipal Court Prosecutor, which FYI, is the lowest prosecutor on the totem pole. They prosecute Class C misdomeanors, which is the lowest offense that exists.
So, it's not like I consulted a Supreme Court justice on that.

There will always be more than one way to skin a cat. Instead of enforcing that statute, an officer, or FD Arson Investigator could always cash bond someone (custodial arrest) for creating an open/uncontrolled burn. That's about a $1,000 ticket you'd have to post a bond for before getting out of jail.
