  • Posse Comitatus Act now null and void?

    Does this seem to go hand in hand with the military training in neighborhoods we saw a couple years ago? Will this really make a difference? Supposed to pass this thing on Monday...

    The bill was drafted in secret by Senators Carl Levin (D-Mich.) and John McCain (R-Ariz.), before being passed in a closed-door committee meeting without any kind of hearing. The language appears in sections 1031 and 1032 of the NDAA bill.

    “I would also point out that these provisions raise serious questions as to who we are as a society and what our Constitution seeks to protect,” Colorado Senator Mark Udall said in a speech last week. One section of these provisions, section 1031, would be interpreted as allowing the military to capture and indefinitely detain American citizens on U.S. soil. Section 1031 essentially repeals the Posse Comitatus Act of 1878 by authorizing the U.S. military to perform law enforcement functions on American soil. That alone should alarm my colleagues on both sides of the aisle, but there are other problems with these provisions that must be resolved.”

    This means Americans could be declared domestic terrorists and thrown in a military brig with no recourse whatsoever. Given that the Department of Homeland Security has characterized behavior such as buying gold, owning guns, using a watch or binoculars, donating to charity, using the telephone or email to find information, using cash, and all manner of mundane behaviors as potential indicators of domestic terrorism, such a provision would be wide open to abuse.

    “American citizens and people picked up on American or Canadian or British streets being sent to military prisons indefinitely without even being charged with a crime. Really? Does anyone think this is a good idea? And why now?” asks Anders.

        Sections 1031 & 1032 are the relevant provisions of the bill, and they state the new powers cannot be used on US Citizens or legal resident aliens. That said, I highly recommend everyone look into the Udall amendment, and call their Senator. They could vote on S. 1867 as early as Monday.

          Under that amendment section B says any of us, dependent upon definitions provided in public law 107-40)(have to have been involved in 9-11), or 107-243 which allowed for attacking Iraq in 2005. Disturbing is part three on page three, which is NOT DEFINED.

          Now, in terms of looking at S.1867, we should also look at the amendments to the bill, found here. Check them out. After looking at that list it is no wonder that we have NO idea what is actually in the law. Everything from banks of Iran to female reproductive access.


          Not sure anyone has the time required to actually analyze this tripe.

            1031 looks to deal with torture.

            Can't find 1032 yet. Did find interesting discussion at this link, paragraph four, in which the white house obviously wants more power to grab whoever they please. It appears that link is in response to this link...

            That www.lawfareblog.com site looks to have good information. May have to make it part of the regular read...

              I'll read it tomorrow and try to consolidate it into a user friendly outline. The really shitty part about this bill is, it's just the military appropriations bill for 2012. All these sought powers are just tacked on to slip them through. If anyone votes against it, the big lobbies can run attack ads against them when they run again. FUUUUUCK! Wish me luck on the read-through.

                Good Luck!

                The hardest part, it would seem, would be keeping track of the offshoots, and having to look up the references to past bills, then determining how those interface. Difficult is an understatement. Hell, reading the 30 minutes of legaleese that I did to compile the above was hard enough, much less what you are undertaking!

                  I perused it and fired off a couple letters last night. We'll eventually have another Civil War and this time it's going to be even worse

                        Every infantry soldier knows that an entrenched population that blends in with noncombatants are almost impossible to fight. It wouldn't be military against us as a lot of us are ex military and that's asking service members to open up on their own home towns

                            You do know it will not be a real (old world type) Civil war.

                            It will only be little fights here and there. The lame stream media will demonize everything we grew up believing to be good and true (freedom) and the people fighting for it.

                            The only chance any of us have is ......??????? Well I don't have that answer, other than educating your fellow Americans of the things you find to be going on that is wrong with the system today, just like Mike is doing.
