    There is only one fix to the idiocy of the people responsible for this fine. It's a chunk of lead in their heads. HOA's have gone too far and the judge that made the ruling has gone too far. I hope people remember them and what they did when war breaks out.



    PARKER COUNTY - A North Texas couple is paying heavily for what they considered free speech.

    Last week, a judge ordered them to pay more than $7,000 for having a yard sign in front of their home.

    “I never thought in a million years this sign would draw this much attention,” said homeowner Clara Russell. “I don’t understand what the problem is.”

    The problems began when her husband, Johnnie, tacked a sign to a tree in front of their home in the rural Remuda Ranch Estates, west of Fort Worth.

    The sign says “Wake Up America” and promotes conservative talk show host Glenn Beck’s 9/12 Project. Neighbors soon started complaining it breaks the subdivision’s deed restrictions banning signs.

    The homeowners association sued and Parker County Justice of the Peace Lynn Marie Johnson ruled in the HOA’s favor, ordering the Russells to pay close to $7,200 in attorney’s fees.

    “That’s an incredible amount of money to me,” Mrs. Russell said. “I’m really confused by it. It’s difficult for me to grasp it.”

    She is appealing the decision. A hearing is scheduled for Monday.

    The couple moved from Keller to this rural subdivision of 200 homes three years ago, partly they say, to escape HOA restrictions. They live on two acres. There are no sidewalks or storm drains in this unincorporated part of Parker County. The sign hung for months near the side of the road, on the edge of their property.

    “It’s a sign on a tree at the end of the day,” Russell said. “I certainly didn’t move out there to offend anyone.”

    Texas law protects yard signs that are clearly political - supporting a particular candidate or cause.

    Neighbors insist the outcry had nothing to do with the sign’s message, but rather in keeping the subdivision attractive.

    “If people don’t want deed restrictions,” said the HOA president, Thomas Stewart, “51 percent of members can vote it away.”

    Still, he admits the board did write a policy allowing other types of yard signs, such as encouraging school spirit. The rules, he insists, are for the “uniformity and betterment of the community.”

    Russell sees a double standard. She can’t understand why some signs are allowed but not hers.

    “It just represents liberty,” she said. “I can't see where that would be offensive to anyone.”

    HOA, especially in heavily populated housing areas have more power than the law in their little areas. (In some cases) Generally they can be run by people who are on a power trip.

    My new home has maybe 20 homes on the road and a loose HOA. Either way, it'll be 100x better than what we have now. It's more like an HOA should be, which is to keep ya from having 20 cars in the driveway and such.

    However, when people complain the HOA has to act on it. When you sign that paper, you're more or less giving rights away. This is minor in comparison to not being able to fly the US flag in my opinion.

      If they are going to let other put up signs, there in no reason for them to fine them so much money for theirs. I can see a $200 fine, but not $7,000. The jusge or somebody is trying to make their own political statement.

        Why would anyone join a HOA? Fuck that. If I want to cut my yard at 3 am with a flame thrower, I'm going to do it.

            Because initially HOAs were a good thing, especially with houses 3' apart or even townhouses connected to each other.

            As far as I can tell, the problems came in when some HOAs started getting extremely snobby and on power trips. i.e. I have a "snobby" type HOA and CURRENTLY live in a low-mid range neighborhood.

            Additionally, HOA homes like mine tend to be good for first time buyers. In prime locations and affordable. Not everyone can afford to live in total BFE and maintain a job that requires work in the DFW area.

              You don't have to live in BFE to not have a HOA, you just have to refuse to live in places with them or if you are in one, push to have it disbanded

                        Complete horseshit! HOAs need oversight, plain and simple. And it is absolutely a double standard that they are making a stink about this particular sign.
                        Oh, and by the way, according to this article, the family didn't even belong to the HOA.

                            Actually, the policy was "some signs". That would piss me off more than an across the board ban on any signs.
                            And yes, if they were tired of HOA rules, why did they move into another one? I wonder if they were picked on because they weren't dues-paying members of the local commissariat.

                              The problem is, you're damned if you do and damned if you don't. If you move into an area with an overly-strict HOA, you get shit like this. If you move into an area with no HOA, you get retards who run a salvage yard out of their driveway and move Aunt Myrtle's trailer into the side yard.

                              Tough to find a middle ground, but as far as my property value is concerned - I'll take the HOA route any day.
