  • Court: Calif. can't ban violent video game sales

Any idiot knows it should be the job of the parents. Next up will be the law banning the sale of Big Macs in San Fagcisco and it will go the same way as well.

WASHINGTON – The Supreme Court says California cannot ban the rental or sale of violent video games to children.

The high court agreed Monday with a federal court's decision to throw out California's ban on the sale or rental of violent video games to minors. The 9th U.S. Circuit Court of Appeals in Sacramento said the law violated minors' rights under the First and Fourteenth amendments.

The law would have prohibited the sale or rental of violent games to anyone under 18. Retailers who violated the act would have been fined up to $1,000 for each infraction.

The court on a 7-2 vote said the law was unconstitutional.

More than 46 million American households have at least one video-game system, with the industry bringing in at least $18 billion in 2010.

True. I'm just glad they got it right, we need them to set some logical precedence, hopefully it will be a speed bump at least in the road to California's insanity.

This was a stupid, over-reaching attempt by Cali to play mommy and they got it shoved down their throat multiple times. They screwed up by categorizing video games as obscene and then citing the Ginsberg standard (ginsberg v new york 1968) as their basis which ruled that pornography was obscene to anyone under 18 simply by looking at it. Video game content isn't obscene. The acts may be a bit violent, but obscene is a stretch.

I'm really surprised Breyer and Thomas dissented. I sincerely thought it would have been 9-0 or possibly 8-1 with Alito dissenting since he seems to be a little baby when it comes to questionable content.

They already banned Happy meal toys in Cali...

I'm surprised that Cali didn't get their way... But then again most software devolpers are in Cali... i'm guessing the loss in revenue would be too much for those comapnies..

                  Off topic... kinda

So since they ruled that Chicago can't ban handguns, when do they enforce that rule in New York?

Just an FYI, the SC lacks enforcement authority.
