    From an LEO's point of view, I would never do a no-knock, kick-in without a magistrate's approval, backed by some good PC from investigations... but what do I know?

        I would never do a no knock entry on an American citizen. You knock, you announce who you are and you do it legally. This bs about no knock is outrageous

          Read the 4th Amendment. After reading it and you still have the same opinion...Your a traitor in the very highest degree! And I will have no empathy for you what so every if you get your ass shot off acting like a jack booted thug . The very reason the 4th exists is to protect both a good L.E.O. and the home owner. If your acting out side the constitution, Your promoting anarchy. You might want to think about that for a minute.

          If some one knocks down my door in the middle of the night yelling POLICE. So what, I have no way of knowing if you are the police at the wrong door, or some creative thief/murderer yelling Police, or FBI wearing an FBI T-shirt, so he don't get his head blown off. Yes this has happened. Look it up on U-tube vids everywhere.

            If you read my post... again... SLOWLY and sounding out the words (hell, read it a few more times), then you will see that I said that there has to be just cause. What I said does not violate the 4th Amendment. I do have a problem with the scenario of them doing so without PC and going through LEGAL PROTOCOL.

            Coming from a guy trying to rip off people for their silver, I wouldn't take what you have to say too personal, though.

                  My logic isn't for sale. The Feds you speak of and the Supreme Court aren't exactly the same entity. Why haven't interest groups challenged every single one of the 22k gun laws? I don't disagree that we are overegilated but a case must have a compelling interest to be heard by the SC as well as legal standing. The 4th amendment and the law in Indiana clearly part ways.

                  If the SC sides with the state (which I doubt) then a ton of issues will arise.
                  Such as violence against officers.

                      So what your saying, The magistrate can over ride the constitution? My statement stands. NO Judge has the right, or authority to even ask you to violate the 4th. or any other part of the constitution, period. And just in case you think a no knock warrant is not in violation of the 4th, YOUR WRONG!

                          If you blow their heads off when they didn't knock and you weren't who they were looking for and they had the wrong house, I don't see you getting in trouble. I mean what are they going to say? "Yeah we busted in the wrong house of someone we weren't looking for and scarred the hell out of them, but eh, he should have just let them cuff him until we figured out it wasn't him." That shit won't fly in texas. Our law says if they in yo' house, you can kill.

                            A magistrate will only sign off if there is valid PC and/or a thorough investigation has been done. That is not a violation of the 4th. A violation would be the absence of that process (like what is listed in the atricle). That is what this whole big uproar is about.

                              That is why I'm against it. This is a violation of the 4th and it also puts liability on the people that are being vicitmized. Our current set-up works just fine. They shouldn't fuck with it. I don't know wht people like tazz are saying otherwise.

                                Well, in my eyes the reality is that the people entering the homes are going to generally be better trained, more alert and aware of what is going on. Meaning, *I* am more concerned (in the bad situations) about the dazzled homeowner being shot while trying to defend him/herself - not knowing WTF is going on.

                                I maybe wrong, but I'd think confusion of the homeowner would generally be a plus for the cops taking down truly bad people. So, all the posts about blowing the cop's head off - I mean, unless you're up at the right time or 24x7 patrolling your home... They will have more shooters, (if you shoot one, I'd count on one of them shooting you), practice a lot more then most homeowners and generally will have the upper hand.
